What are the penalties?
In Hawaii, people are supposed to have a right to live in a safe environment, free from the threat of harm from a family member or spouse. If someone engages in a pattern of physical, verbal, or sexual harassment, the victim can seek a restraining order against the offender.
Under Section 586-11, whenever a person restrained knowingly or intentionally violates an order of protection, he or she is guilty of a misdemeanor. If the protective order violation is in the nature of domestic abuse and it is a first offense, the offender faces:
- A minimum 48 hour jail sentence
- Up to a $500 fine
For a second violation of a protective order, the offender faces a minimum of 30 days in jail and up to $1,000 in fines. Subsequent violations after the second violation of the same order result in a mandatory minimum 30 day jail sentence and a maximum fine of $1,000.
