Class A Felony Charges
Under Section 707-750 one is guilty of promoting child abuse in the first degree if he or she:
- Produces or participates in the creation of child pornography;
- Produces or participates in the creation of pornographic material that uses or contains minors engaging in or assisting in sexual conduct; or
- Engages in a pornographic performance that uses or contains minors engaged in or assisting others in sexual conduct.
Child pornography is any pornographic visual representation, including any photograph, film, video, computer-generated image, or picture, produced by electronic, mechanical, or any other means containing an identifiable minor engaging in sexual conduct.
Promoting child abuse is a Class A felony.
Promoting Child Abuse in the Second & Third Degree
- A person is guilty of promoting child abuse in the second degree if he or she knowingly disseminates, or reproduces any book, magazine, film, computer disk, or any other material that contains an image of child pornography; or
- If the person possesses 30 or more images of any form of child pornography and the content of at least one image contains a child under the age of 12, sadomasochistic abuse of a minor, or bestiality involving a minor.
Promoting child abuse in the second degree is a Class B felony.
A person commits the offense of promoting child abuse in the third degree if he or she knowingly possesses any form of child pornography. Promoting child abuse in the third degree is a Class C felony.
